Dear Attorney General Lungren:
Pursuant to Elections Code Section 9005, we have reviewed the proposed initiative cited as the "California Defense of Marriage Act" (File No. SA 98 RF 0014, Amendment No. 1-S).
This initiative amends California law to provide that only marriage between a man and a woman is valid or recognized in California. We estimate that this measure would likely have no direct fiscal effect on state and local governments because current law generally defines marriage as a civil contract between a man and a woman.
