Pursuant to Elections Code Section 9005, we have
reviewed the proposed initiative entitled “Healthy Californians Act”
(A.G. File No. 07‑0047). This measure would amend the State Constitution
to add affordable health care to the inalienable rights of people.
Background
The Constitution currently provides that all
people are by nature free and independent, and have certain inalienable
rights, among which are those of enjoying and defending life and
liberty; acquiring, possessing, and protecting property; and pursuing
and obtaining safety, happiness, and privacy.
Proposal
This measure amends the Constitution to add
affordable health care to the inalienable rights of people.
Fiscal Effect
This measure would have no direct fiscal effect
on the state. However, the measure could result in indeterminable state
or local government costs depending on how it is interpreted and applied
by the courts.
