Pursuant to Elections Code 9005, we have reviewed a proposed initiative related to the process for revising the State Constitution (A.G. File 26-0002).

Generally, constitutional revisions change a large number of provisions or entail far reaching changes to the fundamental government plan of the state. Only the Legislature can propose constitutional revisions to voters. The proposed measure intends to change this process by establishing an alternative means of proposing constitutional revisions to voters. Under the measure, voters could submit revisions for consideration to the Legislature, and then ultimately return the revisions back to the voters for approval. In addition, proponents of successful constitutional revisions would be able to submit a certain number of initiatives to voters directly (without collecting signatures).

Pursuant to subsection (c) of Section 9005 of the Elections Code, we are informing you that, in our opinion, a reasonable estimate of the net fiscal impact of this proposed initiative measure cannot be prepared within 50 calendar days. Given that the measure aims to expand both the ability to revise the constitution as well as the ability of certain voters to propose initiatives directly, the full scope of the changes this measure would put in place is highly uncertain.

As required by Section 9005, we are informing you that it is our opinion that the measure could result, if it went forward, in substantial net changes in state and local finances.
