Definition of the term “person” for purposes of Article I, Section 7 of the State Constitution.

This measure amends Section 7 of Article I of the State Constitution to define the term person for the purposes of that section. This measure defines the term “person” as “. . . all living human beings from the beginning of their biological development as human beings (i.e. human organism) . . .”. Thus, this measure would confer due process and equal protection rights upon human zygotes, embryos, and fetuses.

This measure repeals the state’s current death penalty statute. In addition, it generally requires murderers to work while in prison and increases the amount of victim restitution that can be deducted from the wages of inmates sentenced to life without the possibility of parole.

Amend the California Constitution to generally require physicians to notify the parent or guardian of a minor under the age of 16 before performing an abortion on that minor, with certain exceptions.

This measure amends the Constitution to require, with certain exceptions, a “physician” (or his or her representative) to deliver a written notice to the parent or legal guardian at least 48 hours before performing an abortion involving an “unemancipated” minor under the age of 16. The measure defines physician as being any person authorized by the state to perform an abortion on an unemancipated minor.
