This measure amends the State Constitution and various statutes relating to (1) the legal rights of crime victims and restitution, (2) the pretrial release of offenders, (3) punishment of offenders in prisons and jails, (4) the granting and revocation of parole, (5) death penalty appeals and other court procedures, and (6) additional compensation and training of prosecutors.

This measure makes several changes to current laws relating to criminal offenders. The most significant of these changes are new criminal justice programs and funding levels; increased criminal penalties for some crimes; various changes to state parole policies; and several other changes to state laws affecting the criminal justice system, including the establishment of a statewide gang registry, changes to hearsay rules and gang injunction procedures, the use of temporary jails, and release of undocumented persons arrested for violent or gang-related crimes.

Authority to Sell General Obligation Bonds. This initiative allows the state to sell $11.7 billion in general obligation bonds for various water and conservation-related programs. This initiative also creates the California Water Infrastructure Commission as a new state agency for the purpose of awarding design and construction contracts for (1) Delta conveyance projects developed pursuant to the initiative and (2) specified surface storage projects funded by proceeds of the general obligation bonds authorized by the initiative and that would be part of SWP, as well as authorizing the commission to issue revenue bonds to cover its operational costs to carry out the responsibilities given to it under the initiative.

This measure requires that all certificated school personnel be paid on the same salary schedule according to their years of experience, level of education, and number of days worked per year. In addition, the measure prohibits any employee of a public school district in the state to receive a salary higher than that of the district’s highest paid classroom teacher.

This measure restricts organizations that receive any funds from public sources from making political contributions (for candidates or issue advocacy). The measure also makes violation of this provision a felony, subject to fines and/or prison sentences.

This proposal adds—beginning in 2009—a new 1 percent surcharge on personal income above $1 million. This would establish a top state income tax bracket of 11.3 percent. It directs 60 percent of the new income tax revenues to the two university systems for undergraduate education. This proposal also freezes CSU resident undergraduate fees at their 2008-09 level for five years. After that period, the proposal would limit subsequent fee increases to no more than the annual percentage change in the California Consumer Price Index.

This measure amends the State Constitution to change the redistricting process for the state Legislature, BOE, and California Members of the U.S. House of Representatives. Instead of the Legislature, an 11-member commission would adjust district boundaries every ten years.

This measure contains provisions that (1) expand drug treatment diversion programs for nonviolent offenders, (2) modify parole supervision procedures and expand prison and parole rehabilitation programs, (3) allow for additional credits for participation and performance in rehabilitation programs that could reduce the time certain offenders stay in state prison, (4) change the penalties for marijuana possession, and (5) make various other miscellaneous changes to state law related mainly to the organization of rehabilitation programs at the California Department of Corrections and Rehabilitation (CDCR).
