Nov 9, 2021 - It does not apply if there is a surviving spouse or registered domestic partner, a surviving child under age 21, or a surviving child who is blind or disabled. If the individual owned a home at the time of death that is worth 50 p ercent or less than the average home in the county, that home is not subject to estate recovery.
